Bittrex Settles with SEC for $24 Million in Charges
Bittrex Inc. and its co-founder and former CEO, William Shihara, have agreed to pay a $24 million fine to the U.S. Securities and Exchange Commission (SEC) to settle charges of failing to register as a national securities exchange. The SEC filed a claim in April 2023, alleging that Bittrex operated as an unregistered broker, exchange, and clearing agency. The exchange and Shihara were accused of removing problematic statements from public channels to avoid regulatory scrutiny. The settlement requires Bittrex and Shihara to follow permanent rules preventing violations of securities laws. They will pay $14.4 million for restitution, $4 million in pre-judgment interest, and a $5.6 million civil penalty.
SEC Emphasizes Enforcement of Crypto Asset Rules
Gurbir S. Grewal, Director of the SEC’s Division of Enforcement, stated that the settlement proves that changing labels or descriptions does not absolve legal responsibility. The economic realities of offerings are what matters. The case involved various units within the SEC, and the settlement highlights the SEC’s commitment to enforcing rules in the crypto asset space.
