BitMEX Founder Criticizes U.S. Legal System’s Treatment of Binance and CZ

BitMEX founder Arthur Hayes has expressed his belief that Binance and its former CEO Changpeng ‘CZ’ Zhao faced unjust punishment from the U.S. legal system. In a detailed blog post, Hayes argued that the treatment of Binance and CZ was “absurd” and highlighted the arbitrary nature of punishment by the state.

Hayes further claimed that the $4.3 billion fine imposed on Binance was disproportionately severe compared to the lenient treatment received by CEOs of “Too Big to Fail” banks responsible for the 2007-2008 financial crisis. He criticized the fact that these bank executives were not prosecuted due to the potential threat it posed to the banking system.

The Challenge to Financial and Political Establishment

Hayes also suggested that CZ’s rapid rise from obscurity to one of the wealthiest individuals on earth within a decade posed a challenge to the financial and political establishment. He argued that CZ’s leadership of a crypto exchange disrupted traditional institutions, transferring control to individuals who were not part of their elite class.

CZ’s Legal Troubles and Resignation

Zhao recently stepped down as CEO of Binance after pleading guilty to anti-money laundering violations. The exchange agreed to pay $4.3 billion to settle charges related to AML and sanctions violations, as well as exiting the U.S. market entirely.

As part of his plea deal, Zhao provided $15 million and had guarantors offer $5 million in collateral for a $175 million bond. He could face up to 10 years in prison and a $50 million fine. A judge ruled that Zhao must remain in the U.S. until his sentencing in February 2024.

U.S. Department of Justice’s Allegations

The U.S. Department of Justice accused Zhao of disregarding legal obligations in pursuit of profit. It claimed that Binance allowed funds tied to criminal activities, including hacking and terrorism, to flow through the exchange. Additionally, the DOJ alleged that Binance failed to prevent over $898 million in illegal trades involving U.S. users and residents from sanctioned countries.

Hayes’ Legal Issues

In 2020, Hayes resigned as CEO of BitMEX following charges by the CFTC for money laundering and operating illegally in the U.S. The U.S. Attorney for the District of New York also charged him with violating the Bank Secrecy Act.

In February 2022, Hayes pleaded guilty to violating the Bank Secrecy Act and paid a $10 million fine. He received six months of house arrest and two years’ probation as part of his sentence.

The divergent treatment of Binance and CZ compared to “Too Big to Fail” bank CEOs raises questions about the fairness and consistency of punishment within the legal system.
