Montenegro Considers Extradition of Do Kwon to the United States, Reports WSJ

The Possible Extradition of Do Kwon

Do Kwon, the founder of Terraform Labs and creator of the Terra blockchain, may be extradited to the U.S. for criminal prosecution in early 2024. This comes as a result of a multi-billion ecosystem collapse involving LUNA and UST. The final decision lies with Montenegro’s Minister for Justice, Andrej Milovic, who has expressed plans to surrender Kwon to American authorities.

A Tussle Between South Korea and the U.S.

Both South Korea and the U.S. governments intend to put Kwon on trial for fraud and securities-related violations. In South Korea, prosecutors have accused him of breaking the Capital Markets Acts, which could lead to a maximum prison sentence of 40 years. Meanwhile, the U.S. Securities and Exchange Commission (SEC) has sued Kwon for offering unregistered securities and using misleading marketing material.

Legal Battles and Imprisonment

Kwon’s lawyers have attempted to dismiss the case, while SEC prosecutors have pushed for a summary judgment. Since March 2023, Kwon has been imprisoned in Montenegro after being arrested with a falsified passport. Although previous appeals to revoke his prison sentence were denied, news of his extradition to the U.S. has emerged following an appeal regarding his transfer out of Montenegro.
