Concerns About Flight Risk

U.S. District Judge Richard Jones acknowledged that it is uncommon to overturn a magistrate judge’s pre-sentencing decision but was convinced by the Justice Department’s reasoning. The department argued that Zhao’s considerable wealth and access to cryptocurrency could lead him to abandon his $175 million bond and escape.

The Case Against Zhao

Zhao is facing up to 18 months in prison on money laundering charges. Binance, the cryptocurrency exchange he founded, recently agreed to pay over $4.3 billion in a settlement with one of the largest corporate fines in U.S. history.

Complex International Status

Judge Jones noted that Zhao’s international status adds complexity to the case. While he is a Canadian citizen, he no longer maintains ties with Canada. The judge also mentioned an unconfirmed report about Zhao being offered citizenship by the UAE, where his family resides and which has no extradition treaty with the U.S.

Remaining Free Within the U.S.

Despite concerns about flight risk, Judge Jones clarified that Zhao does not pose a threat to the public. He allowed Zhao to remain free until his sentencing in February but imposed a condition that he stay within the continental U.S.
