The charges include eight criminal counts and allege fraud by Kwon and Terraform in relation to crypto asset securities, particularly the offering of TerraUSD (UST) and Terra. These legal actions followed extensive investigations that took place after the collapse of Terra in May 2022.

In December 2023, Judge Jed Rakoff ruled in favor of the SEC in the civil case, affirming that Terraform had offered unregistered securities. This summary judgment cleared the way for the trial to begin on March 25, with potential accommodation for Kwon’s participation.
