The Supreme Court of Montenegro Delays Extradition of Terra Founder Do Kwon to South Korea

The Supreme Court of Montenegro has decided to postpone the extradition of Do Kwon, the disgraced founder of Terra (LUNA), to South Korea. This comes after a previous ruling that had approved the extradition process was overturned by the Supreme Court.

Supreme Court Overturns Previous Ruling

According to a new memo, the Supreme Court of Montenegro argues that the lower courts did not follow the law when they initially approved Kwon’s extradition. The court states that it conducted abbreviated proceedings instead of regular ones, exceeding its powers by making a decision on the extradition permit, which is supposed to be the exclusive competence of the Minister of Justice.

The Supreme Court also notes that the proceedings were violated when the Court of Appeal failed to hear the state prosecutor, contrary to the law. This raised concerns about procedural violations in Kwon’s case.

Kwon’s Arrest and Criminal Charges

In March 2023, Do Kwon was arrested in Montenegro while attempting to board a flight to the United Arab Emirates (UAE) using a forged Costa Rican passport. He is currently facing criminal charges in both the United States and South Korea related to the multibillion-dollar downfall of Terra and its stablecoin.

Earlier this month, Kwon’s extradition to the United States was also revoked due to procedural violations.

Hot Take: Extradition Delay Raises Questions About Due Process

The Supreme Court’s decision to postpone Do Kwon’s extradition raises questions about due process and adherence to legal procedures. While it is crucial for alleged criminals to face justice, it is equally important that their rights are protected and that legal proceedings are conducted properly.

By overturning the previous ruling and highlighting the violations of law and procedure, the Supreme Court of Montenegro is emphasizing the need for fair and just legal processes. This decision showcases the court’s commitment to upholding the rule of law and ensuring that justice is served in accordance with established legal frameworks.

However, it remains to be seen what impact this delay will have on Kwon’s case and whether he will eventually be extradited to face charges in South Korea. As the legal proceedings continue, it is essential to monitor how the courts handle the case and whether they prioritize due process and fairness.

In conclusion, the Supreme Court of Montenegro’s decision to postpone Do Kwon’s extradition demonstrates its dedication to upholding legal standards and ensuring that justice is served. This delay provides an opportunity for further examination of the case and ensures that all legal procedures are followed correctly.
