Musk, working with his appointed government team as part of his DOGE initiative, operates under directives aimed at significantly reducing federal spending, decreasing the federal workforce, and streamlining federal regulations. His team has primarily focused on agencies that utilize a minor portion of the federal budget. This includes efforts against the foreign humanitarian assistance program, USAID.
- Musk’s team aimed to access the Treasury’s payment system.
- The goal was to halt funding to the U.S. Agency for International Development, as reported by various sources.
Judge Engelmayer, appointed by former President Barack Obama, acted by temporarily obstructing DOGE from interacting with these systems, following a complaint filed by attorneys general from 19 states against President Trump, the Treasury, and the newly appointed Secretary, Scott Bessent.
Musk’s Reaction to the Ruling ?
Following the judge’s order, Musk expressed his disbelief on X, stating, “This ruling is absolutely insane! How on Earth are we supposed to stop fraud and waste of taxpayer money without looking at how money is spent? That’s literally impossible! Something super shady is going to protect scammers.”
In reply to Musk’s outburst, the New Jersey Attorney General, Matthew Platkin, who is one of the plaintiffs in the case, stated via email that “what’s shady is a tech billionaire breaking the law to try to steal millions of Americans’ sensitive data.”
Contentions in Court ?️
The collective of state attorneys general posited in their complaint that President Trump did not “faithfully execute the laws enacted by Congress” by granting Musk and his team disproportionate access to the treasury’s technological frameworks, including sensitive taxpayer data.
After the stay was implemented, Musk retweeted a follower’s suggestion that DOGE should disregard the court’s ruling entirely.
A Broader Discussion on Judicial Authority ️
Conversing on the matter, Vice President JD Vance expressed on X that judicial oversight over executive operations is not permissible, positing that “if a judge tried to tell a general how to conduct a military operation, that would be illegal.” He further articulated, “Judges aren’t allowed to control the executive’s legitimate power.”
Attorney General Platkin elaborated through a statement emphasizing that compliance with the court order is essential, citing the significant risks posed to cybersecurity and privacy due to the alleged illegal actions undertaken.
Legal experts assert that historically, the judiciary holds the authority to restrict the executive from deviating from constitutional and legal obligations. Joyce White Vance, a law professor and legal analyst, noted how the courts possess jurisdiction to evaluate executive power, particularly when their actions face legal challenges.
Examining the Role of Courts in Government ?️
She pointed out historical precedents that involve judicial checks on executive actions, referring to landmark cases where the courts maintained their role in curbing to executive overreach. Another professor from Duke Law School remarked that both the state attorneys general and the judge acted within their rightful authority, highlighting that the court’s decision was not a final judgment on the case but a temporary restraining order pending merit examination.
Musk has a record of criticizing judges when their decisions do not favor him, as seen in previous confrontations where he expressed dissatisfaction with various court rulings pertaining to business and legal matters.
The ongoing case affecting Musk’s access to Treasury data is officially titled State of New York, et al. v. Donald Trump, et al., based in the Southern District of New York.
