Both parties could then file motions for summary judgment after discovery concludes. If necessary, a trial may take place in 2025.

Judge Failla fully dismissed a class action lawsuit against Uniswap Labs, the Uniswap Foundation, and investors Paradigm, Andreessen Horowitz, and Union Square Ventures. She declined to expand federal securities laws in that case, suggesting that such expansions should be determined by Congress. Other judges have also made significant rulings on whether cryptocurrencies qualify as securities.
