EU Crypto Investor Protections Delayed Until Late 2024

Cryptocurrency Investors in Europe Will Have Limited Protections Until 2026

European cryptocurrency investors are currently not protected under the European Union’s cryptocurrency asset market rules. It will take time for these regulations to come into effect and provide adequate safeguards for investors.

Transition to MiCA Regulations

The European Securities and Markets Authority (ESMA) issued a statement on October 17 regarding the transition to the Markets in Crypto-Assets Regulation (MiCA). The ESMA emphasized that investor protections under MiCA will not be effective until at least December 2024. This means that investors should be prepared to potentially lose all the money they invest in crypto during this period.

No Guarantee of Full Protection

Even after December 2024, there is no guarantee that investors will be fully protected by MiCA until July 1, 2026. Member states have the option to grant crypto service providers an additional 18-month “transitional period” without a license, which may limit investor rights and protections.

Risks Associated with Crypto Assets

The ESMA reminds retail investors that even once MiCA is implemented, there is no such thing as a completely safe crypto asset. Many crypto-assets are highly speculative, and MiCA does not address all the associated risks.

Consultative Paper on MiCA

The ESMA recently released a second consultative paper on MiCA in October 2023. During the implementation phase of MiCA, the ESMA and other relevant authorities will consult with the public on various technical standards.
