Indiana Receives Cryptocurrency Rights Legislation

Indiana Introduces Blockchain and Cryptocurrency Rights Law

Indiana has joined the growing number of states that are taking steps to protect the cryptocurrency rights of their residents. Rep. Heath VanNatter of the Indiana General Assembly recently introduced a bill, known as HB 1388, which aims to ensure that the state government does not intervene in cryptocurrency and blockchain matters.

HB 1388 guarantees the non-discrimination of miners and mining activities, the right to self-custody of digital assets, and exempts miners and stakers from obtaining a Money Transmitting License. It also eliminates capital gains taxes on transactions under $200 and safeguards individuals from potential state-level restrictions on cryptocurrency transactions.

According to Ilya Rekhter, the founder of Megawatt, a sustainable Bitcoin mining company based in Indiana, the bill’s introduction followed several productive meetings with state representatives. Rekhter expressed optimism about the reception of Bitcoin in Indiana and its potential benefits for the state’s residents.

Indiana Joins Nebraska and Missouri in Protecting Cryptocurrency Rights

Indiana’s move to protect cryptocurrency rights makes it the third state, alongside Nebraska and Missouri, to introduce similar legislation. Dennis Porter, the co-founder and CEO of the Satoshi Action Fund, an organization supporting these initiatives, commended the development, stating that it affirms individuals’ rights to engage with Bitcoin and counteracts attempts to restrict self-custody and mining rights.

Porter anticipates that similar bills will be introduced in at least 13 states in 2024, as the fight for Bitcoin adoption extends to the state level.
