Deaton suggests that the case could potentially end up in the US Supreme Court. If Judge Analisa Torres grants a summary judgment in favor of the SEC, Ripple is expected to appeal. Ripple appears to have a long-term legal strategy in place, as evidenced by their summary judgment brief. There is also a possibility of the SEC engaging in negotiations with Ripple to discourage any potential appeal. Deaton believes that the Ripple lawsuit could result in the development of a new securities test, known as the “Ripple test.” The delay in Judge Torres issuing a ruling could be due to the potential for the case to reach the Supreme Court. Ripple’s General Counsel, Stuart Alderoty, also expresses confidence in Ripple’s ability to succeed against the SEC at the Supreme Court.
