Sam Bankman-Fried’s Legal Team Urges for Temporary Release Ahead of Trial

Sam Bankman-Fried’s legal team is once again requesting his temporary release, this time for the duration of his upcoming trial scheduled to begin on October 3. In a letter sent to Judge Kaplan on Monday, the attorneys emphasized the importance of their client’s release for the effective preparation of his defense. They highlighted the limited access to evidence as a significant obstacle to adequately preparing for the trial.

Over the past few months, Bankman-Fried’s legal team has made several unsuccessful requests for his release. Decrypt has reached out to his legal team for comment.

Thousands of Pages of Material

The lawyers representing Bankman-Fried stress the extensive amount of evidence they need to review with their client, underscoring the need for more time. They mention a list of over 50 potential witnesses, thousands of pages of material, and over 1,300 exhibits provided by the government. A significant portion of this evidence consists of intricate financial records, which adds complexity to the case.

The legal team expresses concerns about their ability to effectively represent their client during the trial due to limited consultation time when the court is not in session.

A Detailed Proposal for Release

To address these concerns, Bankman-Fried’s legal team has drafted a detailed proposal for his release on October 2, one day before the trial begins. The proposal includes specific conditions that must be met. Outside of court hours, Bankman-Fried would spend his time at his lawyers’ office, an approved workspace, or a temporary residence in New York City under professional security guard supervision.

After each day’s court proceedings, he would be allowed to meet with his lawyers for essential trial preparations. To ensure security, a private security guard would accompany Bankman-Fried between locations. While at his temporary residence, he would be disconnected from electronic devices and online platforms, with no visitors permitted.

Additionally, the proposal states that Bankman-Fried would consent to a gag order prohibiting him from speaking to anyone except his attorneys, defense team members, parents, and brother for the duration of the trial.
