Montenegrin Court Overturns Decision to Extradite Terra Founder Do Kwon to the US

The founder of Terraform Labs, the crypto firm behind the Terra (LUNA) collapse, has successfully appealed against his extradition to the United States. The Montenegro Appeals Court has overturned the decision to extradite Do Kwon to either the US or South Korea.

Kwon was initially arrested in Montenegro in March for using a fake Costa Rican passport. However, he argued in court that he obtained the passport through a legitimate agency.

At the time, Montenegro was considering extraditing Kwon to the US, with Justice Minister Andrej Milovic reportedly favoring sending him there instead of South Korea, which also seeks to prosecute him.

Both the US and South Korea want Kwon extradited to face fraud charges related to the $40 billion collapse of the Terra ecosystem this year.

After Kwon’s extradition was approved by a Montenegrin court, he appealed the ruling. As a result of winning the appeal, a retrial will be held in the Podgorica Basic Court due to a judge who refused to hear Kwon’s arguments.

The final decision on where Kwon will be extradited, if at all, rests with Montenegro Justice Minister Andrej Milovic.
