Montenegro Appellate Court Revokes Extradition Decision
The Appellate Court of Montenegro has accepted an appeal by Do Kwon’s attorneys, overturning the High Court’s decision to extradite the Terraform Labs founder. The court has annulled the previous decision and returned the case for retrial.
Violation of Criminal Procedure Code
The Appellate Court stated that the High Court’s decision was affected by a significant violation of the Criminal Procedure Code. The court found that the decision lacked clear reasons and did not provide an explanation for the decisive facts.
Not Jurisdiction of High Court
The Appellate Court also revoked another decision by the High Court. It stated that the High Court did not have jurisdiction to determine whether extradition should be postponed, as this falls under the authority of the Minister of Justice.
Retrial and Pending Fate
The case will now go to retrial, and it will take some time before a final decision is reached. Do Kwon is wanted for securities-law violations related to the collapse of Terra and Luna, which cost the market an estimated $40 billion.
