Founder of Failed Crypto Exchange Granted Laptop Access for Trial Preparation
The U.S. Department of Justice (DOJ) has confirmed that Sam Bankman-Fried, founder of the now-defunct FTX cryptocurrency exchange, has been allowed access to a laptop to review discovery materials related to his criminal case. Bankman-Fried, also known as SBF, is currently held at the Metropolitan Detention Center (MDC) in preparation for his trial scheduled for early October. Charges against him include wire fraud and conspiracy to commit securities and commodities fraud.
In response to a judge’s order for a report on Bankman-Fried’s detention conditions, prosecutors stated that he has specific hours on weekdays and weekends to use an air-gapped laptop in a visiting room. This access has been available since August 31, 2023. Last month, SBF’s defense argued that he needs access to online documents to adequately prepare for the trial, as he possesses crucial knowledge related to the case.
The prosecutors assured that there have been no issues with the laptop’s functionality and that the defendant has been provided with a second air-gapped laptop for convenience. Internet speed tests conducted in Bankman-Fried’s cell block area showed satisfactory download transfer rates, with 34 Mbps in the morning and early afternoon, and 7.5 Mbps in the late afternoon.
Defense Claims Insufficient Opportunity for Trial Preparation
Bankman-Fried’s legal team, represented by Cohen and Gresser LLP, responded to the prosecutors’ claims by arguing that the current setup does not allow for meaningful trial preparation. The defense highlighted a specific incident where MDC staff instructed SBF to leave the visitation area early, resulting in the loss of valuable work time. They expressed dissatisfaction with the slow and cumbersome communication process and the impact of visits on discovery review time.
In light of these concerns, the defense reiterated their request for Bankman-Fried’s temporary release, stating that the government’s plan is impractical and does not meet their client’s needs.
