DeFi Education Fund and Paradigm Support Lawsuit Against IRS
A crypto research and advocacy group called DeFi Education Fund (DEF) and crypto investment company Paradigm have filed an amicus brief in support of James Harper’s lawsuit against the US Internal Revenue Service (IRS). The amicus brief urges the Supreme Court to reverse the district court’s decision in Harper’s case and argues that dismissing the complaint could hinder the mainstream adoption of blockchain technology.
“As a leading supporter of, and investor in, crypto and other blockchain-related projects, Paradigm has a strong interest in ensuring that Fourth Amendment caselaw recognizes the critical role that privacy plays with respect to this emerging technology.”
Paradigm emphasizes the importance of privacy in blockchain technology and believes that the district court made an error in concluding that there is no expectation of privacy when transacting on a crypto exchange. Harper’s lawsuit against the IRS originated from a 2017 court order that required Coinbase to provide data on 14,355 users to the IRS.

DEF Files Amicus Brief Focusing on Fourth Amendment Rights
DeFi Education Fund has also filed its own amicus brief, urging the US court to consider the Fourth Amendment rights of cryptocurrency users. The brief highlights that the US government has collected extensive records, including names, social security numbers, addresses, and every cryptocurrency transaction over three years.
“When Harper asserted his rights against the collection of that information, the district court held that the Fourth Amendment, which ‘safeguard[s] the privacy and security of individuals against arbitrary invasions by governmental officials,’ nothing to say about this.”
The DEF argues that there are core differences between crypto technology and traditional finance (TradFi), and the court must take these differences into account. They emphasize the need to protect the privacy and security of individuals in the context of emerging blockchain technology.
Hot Take: Protecting Privacy Rights in Crypto
The support from DeFi Education Fund and Paradigm for James Harper’s lawsuit against the IRS reflects a growing concern within the crypto community regarding privacy rights. As blockchain technology continues to gain mainstream adoption, it is crucial to establish legal precedents that recognize the importance of privacy in crypto transactions.
The amicus briefs argue that dismissing Harper’s complaint could set a precedent that undermines privacy protections in the crypto space. By highlighting the Fourth Amendment rights of cryptocurrency users, both DEF and Paradigm aim to ensure that individuals can transact on crypto exchanges without compromising their privacy.
As regulators and lawmakers navigate the intersection of blockchain technology and traditional financial systems, it is essential to strike a balance that allows for innovation while safeguarding individual rights. The outcome of Harper’s lawsuit could have significant implications for the future of privacy in the crypto industry.
