FTX Founder’s Legal Team Accuses DoJ of Exaggerating Limited Access to Defense Documents

According to FTX founder Sam Bankman-Fried’s legal team, the Department of Justice (DoJ) is misrepresenting their client’s access to essential defense materials. In a letter released on Sept. 8, the defense claimed that Bankman-Fried’s access to necessary legal documents through laptops is restricted. Prosecutors, however, argue that they have resolved the laptop issues in collaboration with the defense.

The bone of contention is the alleged unsatisfactory conditions at the Metropolitan Detention Center (MDC), hindering Bankman-Fried from adequately preparing for his upcoming October trial. Judge Lewis Kaplan, intervening in the matter last week, requested briefs from both parties to outline the conditions at the detention center. However, conflicting reports have emerged from both sides.

The DoJ asserts that Bankman-Fried has daily access to an air-gapped laptop, multiple hard drives with defense material, and an internet-enabled laptop. Nonetheless, the defense claims violations of their client’s Sixth Amendment rights and seeks temporary release or increased computer access to aid in his defense.

Bankman-Fried’s attorneys state that despite having access to an internet-enabled computer at the MDC, he struggles to upload documents due to poor internet speeds. They also argue that he faces difficulties navigating the Discovery or Amazon Web Service (AWS) databases. The defense further asserts that the time allotted for Bankman-Fried’s use of the air-gapped computer falls short of what the prosecution had promised.

Notably, this is not the first time Bankman-Fried’s legal team has voiced concerns about prison conditions. Previously, they requested proper medication for their client and protested the limited food options, claiming Bankman-Fried, who is vegan, was forced to subsist on bread, water, and peanut butter.

The 31-year-old former FTX CEO is facing eight charges related to the collapse of his crypto empire, including wire fraud, money laundering, and unlawful political contributions. He is currently held at the Metropolitan Detention Center in New York after his bail was revoked due to witness tampering.
