A Warning Against Fan Tokens: UK House of Commons Report

A new report from the UK House of Commons Culture, Media, and Sport Committee has raised concerns about soccer clubs using fan tokens. These cryptocurrencies are designed to provide benefits for sports teams or music groups by allowing token holders to participate in voting and decision-making processes. However, the committee is worried that fan tokens do not deliver on their promises of fan engagement and may be presented as a form of engagement despite their price volatility. As a result, the report recommends excluding the use of fan tokens in any measurement of fan engagement in sports.

In response to the criticism, James Newman, Chiliz head of corporate affairs, argues that fan tokens should be regulated as either commodity purchases or financial transactions. He believes that when fans purchase tokens, they are acquiring access and asserting their membership rights to a specific fan community. Newman emphasizes that fan tokens should not replace traditional fan governance but instead improve communication between clubs and fans.

Concerns about NFTs Linked to Sports Clubs

The report also highlights the risks associated with NFTs linked to sports clubs, likening them to gambling. The Committee suggests that retail trading of unbacked cryptoassets should be considered similar to gambling. However, Andrew Griffith MP expresses concerns about discrepancies with international standards, particularly those set by the EU.

Internationally, many countries are establishing regulations for Web3 sports platforms. France’s SREN bill, also known as the “Sorare law,” aims to enhance digital security and regulate emerging technologies like NFTs and cryptocurrencies. French firm Sorare reached an agreement with the National Gaming Authority to avoid being classified as gambling and expand its range of free products.

The SREN bill includes provisions specifically for games based on NFT and cryptocurrency technologies, differentiating them from traditional gambling based on financial commitment, luck, and possible financial gains.

Hot Take: The Debate Over Fan Tokens and NFTs in Sports

The UK House of Commons report raises important concerns about the effectiveness and true value of fan tokens in enhancing fan engagement. While some argue that fan tokens provide access and membership rights to fan communities, others worry about their price volatility and potential deception. This report recommends excluding fan tokens from any measurement of fan engagement in sports.

Furthermore, the report highlights the risks associated with NFTs linked to sports clubs, comparing them to gambling. As countries establish regulations for Web3 sports platforms, the debate over the regulatory framework for fan tokens and NFTs continues. It remains to be seen how different nations will approach this issue and strike a balance between innovation and investor protection.
