Proposal by Spanish Treasury to Reform Taxes, Enabling Confiscation of Cryptocurrencies

Spanish Treasury Proposes Seizing Cryptocurrency for Tax Debts

The Spanish Treasury has put forward a tax reform that would allow the seizure of cryptocurrency assets to settle tax debts. As part of this proposal, the national tax watchdog, Agencia Tributaria, would have the power to confiscate taxpayers’ cryptocurrency holdings when collecting their debts.

This reform was submitted to the European Union in 2021 and is set to be implemented soon. The government is taking swift action to create the necessary conditions for the reform to take effect. Additionally, a royal decree has been issued, designating electronic money entities as tax collection agents. This means that these entities will need to carry out seizure actions on customers’ digital money and crypto assets as requested by the government.

In order to enforce this new regulation, taxpayers will be required to declare any cryptocurrency assets held outside of the country. The data obtained from crypto tax statements since 2021 will also be used to collect tax debts. However, the implementation of these cryptocurrency laws presents a challenge for Spanish regulators, as they will need to adapt their definitions and align with EU-wide regulations that have different interpretations of cryptocurrency.
